SB 805 -- AGRICULTURAL AND HORTICULTURAL PROPERTY SPONSOR: Mayer (Kingery) COMMITTEE ACTION: Voted "do pass" by the Committee on Ways and Means by a vote of 7 to 0. This bill revises the definition of "agricultural and horticultural property" as it relates to property tax purposes to include real property devoted primarily to showing horses. FISCAL NOTE: No impact on state funds in FY 2009, FY 2010, and FY 2011. PROPONENTS: Supporters say that the bill changes the property tax on large horse arenas. If the arena is used for riding or showing horses, and not for spectators, the arena is agricultural property and taxed at 12%. Currently, the arena is considered commercial property and taxed at 32% of the assessed valuation. Some counties already classify horse arenas as agricultural property.
